1. What this covers
How CapFlow Network Inc. handles information collected through capflow.net and in the course of providing financing advisory services.
2. What we collect
- You give us: name, contact details, company details, and — for a transaction — financial statements, tax returns, debt schedules, personal financial statements, acquisition documents and similar deal materials.
- Automatically: IP address, device and browser type, pages visited, referring site, and similar analytics data.
- From others: public and licensed business data, credit or background information where you have authorized it, and information from a referral partner who introduced you.
3. How we use it
To evaluate a transaction, prepare materials, run a competitive financing process, communicate with you, meet legal obligations, and improve our services.
4. How we share it — the part that matters
Before engagement, we do not circulate identifying deal materials to lenders or investors without your written permission. Service-provider processing and other exceptions are described below. If you contact us, send us a deal, or share financials while we are evaluating whether to work together, that information stays internal to CapFlow. We do not show it to lenders, investors or any other outside party unless one of three things is true:
- You have signed an engagement agreement with us and we are running your process — sharing with prospective lenders and investors is then the service you are hiring us to perform; or
- You have given us written permission to share a specific item (email is fine); or
- The material is built to be shared — for example a blind teaser, which is prepared for circulation and does not identify you.
Once you are a client, we share deal materials with the prospective lenders and investors we agree with you, under non-disclosure agreements where applicable, and never with counterparties you have asked us to exclude.
Legal and safety disclosures. We may also disclose information where the law requires it — a subpoena, court order, or lawful request from a government or regulatory authority — or where disclosure is necessary to establish or defend legal claims, investigate suspected fraud, or protect the rights, safety or property of CapFlow or others. This is separate from the conditions above: a legal obligation is not something we can gate behind your permission.
What "outside CapFlow" means. The limits above are about deal counterparties — lenders, investors, buyers, sellers and their advisors. They are not about the tools we use to do our work. Like any modern firm, we run on third-party software: hosting and cloud storage, email and calendar, document and e-signature services, analytics, telephony, and AI services that read, analyze and draft documents. Processing your information in those tools is how we operate internally, not disclosure to an outside party, and it is not restricted by the gate above. We use such providers under their commercial terms.
We do not share your information with lenders you have asked us to exclude.
5. AI and automated processing
We use AI systems throughout our work — to read and analyze documents, draft materials, and manage process.
We do not make credit decisions. Lenders and investors make every credit decision under their own underwriting; no automated system of ours approves, declines or prices financing.
How we may use information you provide. Except where a signed agreement with you provides otherwise, information and materials you provide may be used for our business purposes, including analyzing and improving our services and developing, evaluating and training models and systems. If you need restrictions on the use of particular materials, they are set by a signed agreement — a non-disclosure or confidentiality agreement — not by this policy.
6. Confidentiality of deal materials
Where a non-disclosure or confidentiality agreement is in place, its terms govern the materials it covers. Otherwise, access is limited to the people working on your transaction and the counterparties you approve, and use is as described in section 5.
Service providers — including hosting, email, document and e-signature, analytics, telephony and AI providers — process deal materials on our behalf as part of how we operate, as described in sections 4 and 5. They act under their commercial terms and are not deal counterparties.
7. How long we keep it
We keep information for as long as it is needed for the purposes described in this policy — including maintaining our relationship with you, understanding your financing history, and supporting future financing needs — and for as long as required to meet legal, tax, accounting and audit obligations. In practice that means transaction and relationship records are retained indefinitely. Marketing contacts are kept until you opt out.
You may ask us to delete personal information, and we will do so subject to the exceptions the law allows — for example where we must keep records to meet a legal obligation, complete a transaction, or resolve a dispute.
8. Security
We protect information with access controls and encryption in transit and at rest, using established hosting and storage providers. No system is perfectly secure, and we do not claim otherwise.
9. Your choices and rights
Access, correct, delete or export your personal information; opt out of marketing; withdraw consent. California residents (CCPA/CPRA) and residents of other states with privacy laws have those statutory rights, including the right not to be discriminated against for exercising them. 10. Email, calls and texts
We contact you about your transaction. Marketing messages carry an unsubscribe link; if you opt into SMS, reply STOP to end and HELP for help, and message and data rates may apply. Consent to marketing is never a condition of being served.
11. Cookies and analytics
The site uses essential and functional cookies. When you click to book a meeting, a third-party scheduling tool loads so you can choose a time; if you never click, it does not load. We may use web analytics tools to understand aggregate site use, and tools that indicate whether a visitor is associated with a company; we do not use them to make lending decisions.
CapFlow serves business clients in the United States, and this site is not directed to visitors in the European Union or the United Kingdom. You can still stop analytics collection in your browser — most browsers offer tracking protection.
12. Children
The site is not directed to anyone under 18 and we do not knowingly collect their information.
13. Changes and contact
Material changes will be dated at the top of this page.
